WEBSITE PRIVACY POLICY OF CONFITES.COM 

This document supplements and is part of the Terms and Conditions of use of the Site, setting out Confites’ Privacy policies (hereinafter, the “Privacy Policy”) under which Confites processes your information. All information from Site Users collected in the context of the use of the Services that you provide to Confites will be retained in accordance with the privacy policy set out in this document. Browsing this page and/or using the Services implies your express agreement with its contents and any modifications. If you do not agree, we ask that you stop browsing.

1. Confites reserves the right to modify this Privacy Policy to align it with new legislative, case law, or technical requirements, or any others that allow it to provide better services and content.

2. This Privacy Policy applies only to Confites’ website (hereinafter, the “Site”), and not to third-party sites you access through links provided by Confites or otherwise. In this regard, Confites suggests that, in such cases, you review the policy adopted on each of those sites.

3. Confites will not store or collect a user’s personal information through the Site without prior consent or authorization. Accordingly, Confites will obtain only the personal information that Site Users choose to provide (for example, when contacting Confites by email or registering to obtain certain services). It is important to note that, by registering or including your personal information on the Site, you expressly accept the use of such personal information in accordance with this Privacy Policy. Confites will not sell, disclose, or transmit such information to third parties, unless legally required by court or administrative order or there is the Site User’s express authorization. 

4. For the purposes of this document, “personal information” means information that is particular and distinctive to each person; that is, your first name, last name, mobile phone number, and email address. This data may include, though not necessarily, the name of your Internet service provider, the website you used to link to our Site, the sites you visit from our web portal, and your IP address. Site Users may access and use the Site without disclosing their personal information. Confites does not require Site Users to provide such information as a condition for browsing the Site, except where necessary for the provision of contracted Services, as requested by you.

5. For purposes of using this Site, there is personal information of Site Users that they might consider “sensitive.” In line with the position of most corporate websites, Confites understands this information to include that related to race, ethnic origin, political opinions, trade-union membership, religious or similar beliefs, physical or mental health, sexual life, or criminal records. This special type of information will only be collected when provided voluntarily, or when the law permits or requires its collection. 

6. For your online safety, Confites recommends that you do not share this information on the Site unless you have authorized its use by Confites and agree to the transfer and storage of that information in Confites’ databases. If you do not follow this recommendation, you expressly acknowledge and accept that Confites will be exempt from any liability arising from the use, storage, and transfer of your “sensitive” personal information and that you will not claim—on your own behalf or through third parties—any damage or loss.

7. Confites may obtain anonymous information about its visitors, meaning such information cannot be associated with a specific, identified user. The data retained are only: (i) the date and time of access to our Site for “online” links, for the purpose of identifying peak hours and making the necessary adjustments to avoid issues accessing information; and (ii) the number of daily visitors to the online sections, which allows Confites to learn which information is of greatest interest and to increase and improve its content for the benefit of Site Users. From time to time, in certain information processes, Confites may confirm the recipient’s email address via links included within messages. Confites collects this information to assess user interest and to improve the user’s future experience.

8. In order to create an account or make a present from the Site, the Site User may submit personal information to Confites via the web to register for that purpose. In these cases, in addition to the above: (i) the database containing your personal information remains with Confites, with its data processors, or with servers acting on its behalf and responsible to the Site; (ii) the information Confites obtains through its provision by Site Users will be treated by Confites as confidential information. Economic and commercial information of Site Users will also be treated by Confites as confidential. Any documentation containing a user’s confidential information, regardless of the medium, will be handled carefully and diligently.

9. The Site User may review and correct any personal information stored in Confites’ records if they consider it incorrect or wish to update it for any reason. The Site User may also revoke their authorization for the use of their information.

10. In this regard, and in compliance with Resolution 10/2008 of the National Directorate for the Protection of Personal Data, users are informed that: “The owner of the personal data has the right to access them free of charge at intervals of no less than six months, unless a legitimate interest is proven for that purpose, pursuant to Article 14, paragraph 3 of Law No. 25,326.” “The NATIONAL DIRECTORATE FOR THE PROTECTION OF PERSONAL DATA, the Oversight Body of Law No. 25,326, has the authority to handle complaints and claims filed regarding non-compliance with personal data protection regulations.”

11. Confites hereby informs that the exercise of the rights of access and rectification guaranteed above will be carried out exclusively by means of a notarized letter (carta documento) addressed to “Sres. Confites, Ref.: Datos Personales,” to [email protected].

12. Providing access to user information to third parties unrelated to Confites is strictly prohibited, except for requests made by competent legislative, parliamentary, administrative, or judicial authorities.

13. Confites is authorized to use the information provided by Site Users for internal and/or external marketing purposes and notifications, and may contact the Site User directly for such purposes. In the event of email exchanges, Confites may request further information to confirm the accuracy of the information sent.

14. A cookie is a file—a small piece of information—that a website stores in your browser’s cookie file and that allows the site to remember the user. Cookies cannot be used to run programs or introduce viruses on your computer. They do not provide your email address or personally identify you. On some websites, these cookies may be enabled by Confites to improve the efficiency of your individual use of the Site. They are files that reside on your computer’s hard drive and contain non-identifiable personal information. Cookies are thus identifiers that our web server may send to identify the computer being used for the duration of the session; therefore, only the user’s computer is identified, not their personal information. If cookies are used, Confites does so to provide you with better service when you revisit the Site, for example, helping you avoid re-entering data you have provided previously. Most browsers are set to accept these cookies automatically, but the user can disable cookie storage or adjust the browser to notify them before a cookie is stored on their computer. To that end, set your browser options not to accept cookies. Doing so, however, will prevent access to all of the Site’s features.

15. The Site may contain links to other sites that are governed by their own privacy policies, for which Confites is not and will not be responsible under any circumstances.

16. Standard emails sent over the Internet may be subject to possible interception, loss, or alteration. Confites is not and will not be responsible for them or for any damages or issues of any kind related to emails you send to Confites.

17. Any judicial or extrajudicial dispute arising from the application or interpretation of this Privacy Policy is governed by the laws of the Argentine Republic, excluding private international law rules, and shall be submitted to the Ordinary Courts of the City of Buenos Aires. Likewise, the nullity of any provision of this Privacy Policy document will not render the entire text null, but only the challenged provision.

18. Confites establishes its address at Avenida Pueyrredón 2376, 8th Floor, where all legal notices must be served.
